The Buyer must obtain from DIMAR, through Buyer’s maritime agent in Colombia, approval for the Nominated Vessel to enter the port where the loading equipment is located and anchor at least 24 hours before the Nominated Vessel’s arrival.
The Nominated Vessel must have all the equipment and facilities required to carry out the loading at the bunker delivery equipment, in accordance with items (i), (ii) and (iii) of Section 11.d above.
No later than forty-eight (48) hours prior to the ETA, the Customer must have physically accumulated or obtained Grain Entitlement equivalent to or greater than the Nominated Tonnage for each Grade to be loaded onto the Customer’s Nominated Vessel.
No later than forty-eight (48) hours prior to the earlier of the Fixed ETA Date and the ETC the Customer must have physically accumulated or obtained Grain Entitlement equivalent to or greater than the Nominated Tonnage for each Grade to be loaded onto the Customer’s Nominated Vessel.
For the avoidance of doubt, nothing in this Agreement requires the Operator to pilot, handle or manoeuvre the Nominated Vessel in the Berth or the wider marine area.
