Seller shall be responsible for, and reimburse Buyer for, any out-of-pocket costs incurred by Buyer to obtain such Network Integration Transmission Service; provided, that, for the avoidance of doubt, at no time shall Seller be responsible for, or be required to reimburse Buyer for, any charges, fees or costs incurred by Buyer pursuant to the rates for NITS service under the MISO Rules.
Without limiting the foregoing, Seller shall (at its own expense) obtain prior to the Delivery Term Commencement Date, and maintain throughout the Delivery Term, Full Deliverability, except that Buyer shall (at Seller’s expense) obtain NITS according and subject to Section 7.6(b).
Each of the Companies will bear the risk of any changes in the charges and requirements associated with delivery service and NITS.
