New Trust definition

New Trust has the meaning set out in section 2.05(a) of this trust agreement;
New Trust means a Delaware statutory trust (including an existing Delaware statutory trust that has not previously offered any securities), all of the common securities of which are directly or indirectly owned by the Depositor, formed (or, in the case of such existing Delaware statutory trust, designated) by the Depositor for the purpose of remarketing the Notes.
New Trust means a newly formed Delaware statutory business trust, all of the common securities of which shall be owned by U S WEST.

  • If the sum of the Initial Asset Transfer plus the Benefit Payments exceeds the Pension Plan Asset Transfer Amount, then the New Trust shall promptly return such excess.
