Network Software. Has the meaning given in Attachment 4-B. Network Topology Means the arrangement in which the nodes or interfaces to the Network are connected. New Advances Has the meaning given in Section 9.12(e) of the Agreement. New Services Means services requested by DIR, DIR Customers, or required by applicable Laws (without limiting the obligation of the Parties under Section 15.11 of the Agreement) (i) that are materially different from the Services, (ii) that require materially different levels of effort or resources from Service Provider to provide the Services, and (iii) which are not required for Service Provider to meet the Service Levels. For the avoidance of doubt, New Services shall not include (a) increases in the volume of Services for which there is an associated Resource Baseline or charging methodology, or (b) the disaggregation of an existing service from a Functional Service Area. Nine-Month Measurement Window Means if Section 8.1 of Exhibit 3 is used to establish the Expected Service Level and Minimum Service Level commitments, the nine (9) consecutive months of measurements immediately preceding the month in which DIR provided written notice to Service Provider. Noncompliance Means each instance that the Software, Equipment, Systems, or other Deliverable or milestone fails to meet its Acceptance Criteria or is otherwise deficient in DIR's reasonable discretion (in accordance with the Service Management Manual or other criteria agreed by the Parties, to the extent applicable). Non-Consolidated Service Location Means Legacy Data Centers and Business Offices.
Network Software means ActaMed's personal computer version of the ProviderLink and ActaLink presentation and network software programs, under whatever name marketed, and the SCAN Software and the ActaLab Software, and all Changes to them, which are licensed to Automated Providers and which allow access to the Network for the transmission of laboratory test order entries and reception of test result information, or other software program for use by ActaMed in the transmission of test order entries and reception of test result information which is licensed to Automated Providers.
Network Software means the personal computer version of the ProviderLink and ActaLink presentation and network software programs, and all updates to them, which are licensed to users and which allow access to the Network for the transmission and reception of information.

The Network, Software, and documentation contain material that is protected by United States Copyright Law and trade secret law, and by international treaty provisions.
ActaMed will install the Network Software at UHC or Provider sites and connect them to the Network, when mutually agreed by the parties.
ActaMed will provide all reasonably necessary and appropriate end user support for issues relating to connectivity to the Network utilizing any Network Software in use at such time, including without limitation, help desk assistance to Automated Providers, hardware support to applicable Automated Providers, user training and bug fixes to the Network.

More Definitions of Network Software
Network Software means all Software embedded in or installed on Network Equipment, including routers, switches, hubs and PBXs and that is necessary to their functionality. Neutral Adviser has the meaning set forth in Section 22.2.1 of the MSA.

Problem Management: Problem management provides resolution and follow-up assistance relating to FDT related problems. Daily and monthly reporting is provided by problem management for tracking by the Parties.

Network Software and "Network Applications" as defined in Schedule A (per the table concerning AIBs set forth therein) and Schedule B, and satisfaction of certain testing and verification standards to be developed pursuant to Schedule F during Phase II. Contractor shall deliver a notice to Duquesne certifying that it has completed Milestone Number 29 on a particular date, and Duquesne shall promptly conduct such testing and inspections as are necessary to verify that the Milestone has been completed. In the event that during the course of this testing and inspection Duquesne finds that Contractor failed to meet Critical Milestone Number 29 as defined above, Contractor shall be required to proceed immediately in accordance with the terms of Section 4.3(e)(i) as if it had originally failed to meet that Milestone; provided, however, that if the particular failure to meet Critical Milestone Number 29 is a minor and inadvertent Nonconformity or variance from its requirements, of which Contractor had no knowledge at the time of its Certification that the Milestone had been met, then Contractor shall have the right for * following notification of the Nonconformity or variance to Correct it before Contractor can be required to proceed under Section 4.3(e)(i).

Network Software means any Software that is either proprietary to Nokia Siemens or is licensed to Nokia Siemens from a third party, which is incorporated into any item of Network Equipment and used to operate such Network Equipment and to make the Network Equipment perform in accordance with its applicable Specifications. Network Software includes the RAN Software and the Core Software.
