Needed definition

Needed means: for the implementation of the Project, that Access Rights are needed if, without the grant of such Access Rights, carrying out the tasks assigned to the recipient Participant would be technically or legally impossible, significantly delayed, or require significant additional financial or human resources; and for exploitation of a Participant’s own or jointly owned Foreground, that Access Rights are needed if, without the grant of such Access Rights, the exploitation of a Participant’s own or jointly owned Foreground would be technically or legally impossible.

More Definitions of Needed

Needed means “technically essential” for the implementation of the Project and/or in respect of Use of Foreground and, where Intellectual Property Rights are concerned, shall mean that those Intellectual Property Rights would be infringed if the Access Rights were not granted;
Needed means: For the implementation of the Project: Access Rights are Needed if, without the grant of such Access Rights, carrying out the tasks assigned to the recipient Party would be impossible, significantly delayed, or require significant additional financial or human resources. Parties have access rights if they are “Needed”, and this provision aims to make this condition more precise and easier to work with. It makes access “Needed for the Project” very open in order to make work on the Project as uncomplicated as possible. It is stricter regarding the access “Needed for exploitation” because Parties want to be reasonably sure that other Parties - can only claim access to their IPR if they have no other options. The requesting Party has to show its Need for Access Rights.
