Notwithstanding anything to the contrary, Seller shall use Commercially Reasonable Efforts to achieve Commercial Operation of the Facility at a Nameplate Capacity for the Generating Facility equal to the Expected Capacity and Storage Capacity for the Storage Facility equal to the Storage Expected Capacity.
For Small Generator Facilities with a Nameplate Capacity of 1 MW or above, the Interconnection Customer shall carry adequate insurance coverage that shall be acceptable to the EDC; provided, that the maximum comprehensive/general liability coverage that shall be continuously maintained by the Interconnection Customer during the term shall be not less than $2,000,000 for each occurrence, and an aggregate, if any, of at least $4,000,000.
