This Agreement is explicitly conditioned upon approval in its original form by the Michigan Public Service Commission (MPSC).
Unless otherwise expressly provided in this Agreement, the sale and delivery of steam under this Agreement is governed by the terms of the Company’s General Rules as amended by the MPSC from time to time.
Nothing in this Section 8.02(b) shall affect the obligation of the Servicer to observe any applicable law (including any MPSC Regulation) prohibiting disclosure of information regarding the Customers, and the failure of the Servicer to provide access to such information as a result of such obligation shall not constitute a breach of this Section 8.02(b).
