Modified Product definition

Modified Product shall have the meaning set forth in Section 11.08 of this Agreement.
Modified Product means any Licensed Product that has been redesigned or modified as compared to the form, design or specifications for such Licensed Product set forth in any regulatory submission or any supplement related to such submission used to obtain Regulatory Approval for the DBS System or its components anywhere in the Territory, such that a separate regulatory submission and Regulatory Approval for such Licensed Product would be required prior to the sale of such Licensed Product in its modified form.
Modified Product means a Product (such as a voice card, WAN card or other separately identified product) which is the subject of the modification and in which the modification is incorporated.

Examples of Modified Product in a sentence

  • Such notification shall be made as soon as commercially feasible, but in any event, prior to the manufacture of a Modified Product intended for Commercial Use.

  • ABI shall have the right and option, in its sole discretion, during such 30 day period to terminate distribution of such Modified Product under this Agreement, in which event such Modified Product shall no longer be deemed a Product for purposes of this Agreement.

More Definitions of Modified Product

Modified Product means any Product that either: (a) does not contain any Compound that was created, developed or in-licensed by Curis, but contains one or more Compounds created, developed or in-licensed (other than from Curis) by Genentech; or (b) contains a Compound that is [**] a Compound [**] under U.S. patent law, [**].

Modified Product means the Software Products (as they exist as of the date of the execution of this License Agreement) as modified by the Derivative Works created by StarBase pursuant to the terms and conditions of this License Agreement. A Software Product shall be considered a Modified Product only if Site's branding of such Software Product is replaced in its entirety by StarBase's own proprietary branding.
