Minimum Return definition

Minimum Return means, with respect to the calculation of any Company Redemption Price, Event of Default Acceleration Amount, Fundamental Change Repurchase Price or Minimum Return Maturity Amount, the amount below in the “Minimum Return” column that corresponds to such date in the “Determination Date” column of such (i) Company Redemption Date, with respect to a Company Redemption, (ii) the date of the Event of Default Notice or the date of automatic acceleration pursuant to Section 10(B)(i), with respect to any acceleration pursuant to Section 10(B), (iii) the Fundamental Change Repurchase Date, with respect to any required repurchase of this Note upon a Fundamental Change and (iv) the Maturity Date, with respect to payment of the Note on the Maturity Date pursuant to Section 4(C):
Minimum Return means the minimum return, expressed as a percentage rate per term, that we set for a Variable Return on the Investment Date for a Deposit, as indicated on its certificate or confirmation notice we provide to you;

Minimum Return means a minimum return to the limited partners holding Property LP Units equal to 8% per annum, cumulative but not compounded, calculated on the limited partners’ Net Equity in the Property LP, which amount represents a cumulative preferential entitlement of the limited partners holding Property LP Units to distributions and allocations of Distributable Cash, Extraordinary Distributions, net income and taxable income of the Property LP in priority to any allocations or distributions of the Incentive Management Interest to the Property GP;
