Maximum Capital Expenditure Amount definition

Maximum Capital Expenditure Amount means, with respect to any fiscal year of the Company, an amount equal to the greater of (i) $140,000,000 and (ii) 70% of Consolidated EBITDA for the immediately preceding fiscal year of the Company.
Maximum Capital Expenditure Amount means for any Fiscal Year, $25,000,000."
Maximum Capital Expenditure Amount appearing in Section 1 of the Lease is hereby amended by deleting such definition in its entirety and inserting the following text in lieu thereof:

  • The Company will not, nor will it permit any Subsidiary to, expend in excess of the Maximum Capital Expenditure Amount (in the aggregate) for Consolidated Capital Expenditures during any fiscal year of the Company.

Maximum Capital Expenditure Amount has the meaning assigned to that term in subsection 6.5C.
