Material Delivery. Within 60 days after award date, Purchaser shall provide Forest Service a written schedule showing the desired delivery dates of any material to be supplied by Forest Service. With reasonable notice, schedule may be amended by agreement. Forest Service agrees to make delivery within 15 days after the scheduled delivery dates that are at least 60 days after the schedule is submitted, unless prevented by causes beyond control of Forest Service. If Purchaser does not provide Forest Service the written schedule within the period provided in this Subsection, Forest Service agrees to make delivery within 90 days after a late schedule is submitted, unless prevented by causes beyond control of Forest Service. After delivery to and written receipt by Purchaser, Purchaser is responsible for installation of needed material and for any loss of or damage to such material due to Purchaser's negligence prior to installation or return of unused material to Forest Service. At Purchaser’s option, Forest Service deliveries shall be to Purchaser’s storage area, as agreed, or to the nearest practicable point to the job site along existing roads. Unused material shall be returned to Forest Service at location of delivery, unless agreed otherwise.

The Contractor shall provide the Engineer with one copy of all invoices (prices are not required) for materials delivered to the project with the following exceptions: asphalt concrete; dense graded aggregate, to include aggregate base, sub base, and select material; fine aggregate; open graded coarse aggregate; crusher run aggregate; and road stabilization aggregate. The printed weights of each load of these materials, shall accompany the delivery, and such information shall be made available to the Engineer or his designated representative at the Project.

Material Delivery. The Design-Builder shall advise the Quality Assurance Manager and the Department at least two (2) weeks prior to the delivery of any Material from a commercial source. Upon delivery of any such Material to the Project, the Design-Builder shall provide the Department with one copy of all invoices (prices are not required). The following Materials shall also comply with Section 109.01: asphalt concrete; dense graded aggregate, to include aggregate base, Subbase, and Select Material; fine aggregate; open graded coarse aggregate; crusher run aggregate; and Road stabilization aggregate. The printed weights of each load of these Materials, as specified in Section 109.01, shall accompany the delivery, and such information shall be furnished to the Lead QA Inspector at the Project.

Material Delivery. The Contractor will be responsible for all material delivery, in accordance with applicable time restrictions and local law.

Any difficulty or controversy that may arise between the contracting parties regarding the application, interpretation, duration, validity or execution of this agreement or any other controversy regarding it, will be subject to arbitration, with the sole exception specific matter related to the real volume that can extracted from the referred xxxxx, matter that will be subject to the technical arbitration referred to in previous clause seventh. This arbitration will be in accordance with the current Arbitration Procedural Regulations of the Arbitration and Mediation Center of Santiago. The parties grant irrevocable special power to Xxxxxxxx'x Chamber of Commerce, so that, upon written request from any of them, designate an arbitrating arbitrator from the members of the arbitration body of Arbitration and Mediation Center of Santiago, submitting it in this case to the procedure established by the Regulation of said Center, which evidenced through public deed dated December 10, 1992, executed in the Public Notary for Santiago of Mr. Xxxxxx Xxxxxxxxx Xxxxxx and to its subsequent amendments, that the parties declare to know and accept. Against the arbitrator's resolutions no appeals will FREE TRANSLATION be filed, for which reason the parties expressly waive them, including those of complaint and cassation. The arbitrator is specially empowered to settle any matter related with his competence and/or jurisdiction.
