marketing communication means any disclosure of information other than a disclosure required by Union or national law, or other than the financial education material referred to in Article 88b, or other than investment research that meet the conditions to be treated as such, that directly or indirectly promotes or entices investments in one or several financial instruments or categories of financial instruments or the use of investment or ancillary services provided by an investment firm that is made:
marketing communication means any form of information communicated by or on behalf of an investment firm to the public that advertises, makes a recommendation in relation to, or is capable of acting as a solicitation regarding, investment services, and/or where appropriate ancillary services and/or financial instruments. For these purposes, information is issued to the public if it is designed for, directed at and/or addressed to, a number of people. Information is not issued to the public if: - it is directed at one specific person or group of persons acting jointly, unless it forms part of an organised marketing campaign; or- it is only communicated by the investment firm to other members of its group, provided that the investment firm takes all reasonable steps to ensure that none of the recipients pass the communication to a person who is not a member of its group. The following shall not be considered as marketing communications for the purposes of this advice:
marketing communication means the recommendation covered in section 26 the Insider Dealing and Market Manipulation (Market Abuse) Law, relating to financial instruments as defined in Part III of the Third Annex of the Law, and does not meet the conditions set by the definition of investment research;
