Licensed Platforms means any and all personal computer, mobile, tablet, video game console, interactive television, virtual reality, mixed reality, augmented reality and any other operating system on which video games are played, whether now known or hereafter devised, including PC, Apple Macintosh, Microsoft Xbox, Sony PlayStation, PlayStation VR and Vita, Nintendo Switch, Wii, Wii-U, DS and 3DS, Oculus and Valve/HTC Vive, Apple Macintosh, OS X and iOS devices including iPhone and iPad, Google Android devices and all future versions of each of the foregoing. Anticipated Release Date; Release Date May 25, 2023, being the date currently planned by Developer for general offering and sale of the Licensed Game in the Territory (subject to extension by agreement of Fig and Developer, such agreement not to be unreasonably withheld by Fig) (the “Anticipated Release Date”). Licensed Platforms means any and all personal computer, mobile, tablet, video game console, interactive television and any other operating system on which video games are played, whether now known or hereafter devised, including but not limited to Microsoft Windows operating systems, Microsoft Xbox 360, Xbox One, Sony PlayStation 3, PlayStation 4, and Vita, Nintendo Wii, Wii-U, DS and 3DS, Apple Macintosh, OS X and iOS operating systems, Google Android operating system, Linux operating system, and all future versions of each of the foregoing; provided, however, Licensed Platforms does not include any virtual reality, mixed reality, or augmented reality system, whether now known or hereafter devised, including but not limited to Playstation VR, Oculus Rift and Valve/HTC Vive.

  • Developer represents and warrants that the sum of the (i) Fig Funds; (ii) the proceeds of any Fig Rewards Crowdfunding; and (iii) funds currently available or will be available to Developer in a reasonable timeframe, is an amount that will be sufficient to develop the Licensed Game for the Licensed Platforms in accordance with the Agreement.

  • Developer shall develop and maintain the Licensed Game in material conformity with the Game Design Document and in accordance with first-class professional standards in the games business for the Licensed Platforms.

  • Developer shall develop and maintain each Licensed Game in material conformity with the Game Design Documents provided to Fig at the time a License Game is added to this Agreement, and in accordance with industry standards in the games business for the Licensed Platforms.

  • Developer represents that the sum of the (i) Fig Funds; (ii) the proceeds of a successful rewards crowdfunding campaign on Fig; and (iii) funds currently available or will be available to Developer in a reasonable timeframe, is an amount that will be sufficient to develop the Licensed Game for the Licensed Platforms in accordance with the Agreement.

  • Additionally, Developer shall promptly deliver to Fig any and all bug fixes, updates or upgrades of the Licensed Game that Developer develops for the Licensed Platforms, if any.

Licensed Platforms means any and all personal computer, tablet, video game console, interactive television, virtual reality, mixed reality, augmented reality and any other operating system on which video games are played, whether now known or hereafter devised, including PC, Apple Macintosh, Microsoft Xbox, Sony PlayStation, Nintendo Switch provided if at any time before the Tier 2 Calculated Rate is in effect Developer releases the Licensed Game on platforms that are not captured in the definition of Licensed Platform, such platforms will be automatically added to the definition of Licensed Platform by operation of this Agreement unless the Licensed Game’s appearance on the new Licensed Platform (i) requires additional investment or funding in furtherance of such appearance in an amount equal to or exceeding $10,000 and (ii) Fig does not provide such additional funding after being provided a preemptive right to do so. Licensed Platforms means the computer platforms(s), computer language(s), operating systems or versions thereof specified in a Schedule on which Pumatech is authorized to use the Programs.
