Level VI Status definition

Level VI Status exists at any date if, on such date, the Borrower has not qualified for Level I Status, Level II Status, Level III Status, Level IV Status or Level V Status.
Level VI Status exists at any date if, at such date, no other Status exists.
Level VI Status means none of Level I Status, Level II Status, Level III Status, Level IV Status nor Level V Status exists.

  • If at any time the Borrower has no ▇▇▇▇▇’▇ Rating or no S&P Rating, Level VI Status shall exist.


More Definitions of Level VI Status

Level VI Status means none of Level I Status, Level II Status, Level III Status, Level IV Status nor Level V Status exists, but, subject to the provisions of Schedule 1, the Borrower’s S&P Rating is BBB+ or higher, its Fitch Rating is BBB+ or higher and its ▇▇▇▇▇’▇ rating is Baa1 or higher.
Level VI Status exists at any date if, as of the last day of the fiscal quarter of the Company referred to in the most recent Financials, the Company has not qualified for Level I Status, Level II Status, Level III Status, Level IV Status or Level V Status.
Level VI Status exists at any date if on such date, (i) the Borrower has not qualified for Level I Status, Level II Status, Level III Status, Level IV Status or Level V Status and (ii) the Borrower’s ▇▇▇▇▇’▇ Rating is Baa3 or better or the Borrower’s S&P Rating is BBB- or better.
Level VI Status means ▇▇▇▇ ▇▇ Level I Status, Level II Status, Level III Status, Level IV Status nor Level V Status exists.
Level VI Status as set forth below:
Level VI Status exists at any date if, on such date, the Parent has not qualified for Level I Status, Level II Status, Level III Status, Level IV Status or Level V Status.
Level VI Status means, on any date, the circumstance that none of Level I Status, Level II Status, Level III Status, Level IV Status or Level V Status exists and the Consolidated Total Debt to Consolidated EBITDA Ratio is greater than or equal to 3.25:1.00 as of such date.
