The Servicer shall promptly report to the Origination Trust any failure on its part to retain possession of the Lease Documents or Title Documents and promptly take appropriate action to remedy any such failure.
In no event shall Landlord or the Landlord Parties be liable for, and Tenant, on behalf of itself and all other Tenant Parties, hereby waives any claim for, any indirect, consequential or punitive damages, including loss of profits or business opportunity, arising under or in connection with the Lease Documents.

The parties further consent and agree that (i) to the extent a party signs this Lease (or any of the other Lease Documents) using electronic signature technology, by clicking “SIGN”, such party is signing this Lease (or such other of the Lease Documents) electronically, and (ii) the electronic signatures appearing on this Lease (or such other of the Lease Documents) shall be treated, for purposes of validity, enforceability and admissibility, the same as handwritten signatures.
