Issuer Trust has the meaning specified in the first paragraph of this Guarantee Agreement.

Issuer Trust means the Delaware statutory trust heretofore known as “PrivateBancorp Capital Trust IV,” which was formed on May 1, 2008 under the Delaware Statutory Trust Act pursuant to the Original Declaration of Trust and the filing of the Certificate of Trust, and continued pursuant to this Declaration of Trust under the name “PrivateBancorp Capital Trust IV”.
