Industry Class definition

Industry Class means, for purposes of computing the Borrowing Base, each industry class as determined by applying, in separate tests, the classification categories provided by Moody's, or, in the event that Moody's does not classify a particular Person, as classified by the Adviser based upon the Moody's industry classifications.
Industry Class means each industry class determined by the Adviser based upon the criteria set forth on Schedule IV hereto, as such Schedule IV may be amended and supplemented from time to time with the prior written consent of the Agent.
Industry Class means each industry class as determined by the Manager based upon the criteria set forth on Schedule III hereto, as amended and supplemented in accordance with this Agreement.

  • Without the prior written consent (which consent shall not be unreasonably withheld or delayed) of the Program Agent and each Direct Lender (i) unless required by a change in Applicable Law (including, without limitation, the Investment Company Act and the Securities Act) make or permit any material change in the Investment Policies and Restrictions, or (ii) make or permit any change in any Industry Class used to compute the Borrowing Base.

  • Without the prior written consent (which consent shall not be unreasonably withheld or delayed) of the Administrative Agent, make or permit any change in any Industry Class used to compute the Borrowing Base.

  • Excluded Corporation, Mitsubishi Electric Persons and Persons who are Automotive America, Inc., included in the Quebec Mitsubishi Electric Sales Canada Settlement Class and the BC Inc., Mitsubishi Electric US Settlement Class are excluded Holdings, Inc., Aisan Industry Co. from the Ontario Settlement Ltd., Franklin Precision Industry, Class.

Industry Class means the following industries: Transportation, Consumer Services, Distribution, Energy Services, Environmental Services, Food Services, Pipe Fitting, Renewable Energy, Software, Specialty Chemical, Agriculture, Forestry, Fishing and Hunting, Automotive, Business Process Outsourcing, Consumer Goods Manufacturing, Financial Services, Food Manufacturing, Healthcare, Hospitality, Industrial Manufacturing, Professional Scientific and Technical Services and Retail.
Industry Class means the Seller internal code corresponding to the CNAE (Clasificación Nacional de Actividades Económicas) code of the Direct Debtor in the Mercantile Registry (Registro Mercantil), as set forth in the table attached as a Schedule to the Receivables Sale Agreement.
Industry Class set forth in Section 1.01 of the Credit Agreement is hereby amended by replacing the words "Credit Suisse First Boston High Yield Index" set forth therein with the words "▇▇▇▇▇▇▇ ▇▇▇▇▇ ▇▇▇▇▇▇ High Yield Index".
