Indenture Security Documents definition

Indenture Security Documents means the Collateral Assignment of Mortgage, the Collateral Assignment of Underlying Notes and Security Documents, the Notes, the Indenture, the financing statements now or hereafter executed in connection herewith and any and all other agreements, certificates (including, without limitation, Officer's Certificates), instruments or documents executed by the Issuer evidencing or securing the Notes. INDEPENDENT when used with respect to any specified Person means such a Person who (i) does not have any direct financial interest or material indirect financial interest in the Issuer, any Underlying Borrower, the Trustee, the Fiscal Agent, the Special Servicer or the Servicer or any Holder of a Note or in any of their respective Affiliates and (ii) is not an officer, employee, promoter, underwriter, trustee, partner, director or Person performing similar functions of or for the Issuer, the Trustee, the Fiscal Agent, the Special Servicer or the Servicer or any Holder of a Note or any of their respective Affiliates.

Indenture Security Documents means all (i) Security Documents (as defined in the First Priority Notes Indenture) and (ii) Security Documents (as defined in the Second Priority Notes Indenture).

Indenture Security Documents means the security agreements, pledge agreements, mortgages, deeds of trust, collateral assignments and related agreements, including the Indenture Pledge and Security Agreement, creating security interests in the Indenture Collateral as contemplated by the Indenture.

Examples of Indenture Security Documents in a sentence

• All increases effective from the first pay period after 1 November of the relevant year.

• In addition, from time to time, the Issuer will reasonably promptly secure the obligations under this Indenture, Security Documents and Intercreditor Agreement by pledging or creating, or causing to be pledged or created, perfected security interests with respect to the Collateral, in each case to the extent reasonably requested by the Trustee, and in accordance with the Security Documents (including the Intercreditor Agreement).

• The authority conferred upon Trustee by this Deed of Trust shall automatically extend to any and all other successor, substitute and replacement Trustee(s) successively until the obligations secured hereunder have been paid in full or the Trust Estate has been sold hereunder or released in accordance with the provisions of the Mortgage Notes Indenture Security Documents.

Indenture Security Documents shall have the meaning assigned to such term in the recitals to this Agreement.

Indenture Security Documents means the Security Documents (as defined in the Indenture) and any other agreement, document or instrument pursuant to which Liens are granted or purported to be granted securing Indenture Obligations or under which rights or remedies with respect to such Liens are governed.
