• The amount of the Loss or of any payment to be made by OTH pursuant to this Clause 8.4 or any other provision of this Clause 8 shall be equal to, and shall in no circumstances exceed, the amount which the Purchaser or HWL would otherwise have been entitled to recover from the Seller under the terms of this Agreement.
