Hedging Documents definition

Hedging Documents means the documents entered into between the Borrower and a Hedging Bank for the purpose of implementing any hedging in connection with interest payable in respect of the Senior Liabilities, the Secured Incremental Liabilities and/or the Secured Permitted Refinancing Liabilities.

Hedging Documents means any and all currency or interest rate swap and/or interest cap and/or other hedging agreements entered into, or to be entered into by a Borrower with a Bank in relation to the obligations of such Borrower hereunder;

Hedging Documents means the documents entered into between a member of the Group and a Hedging Bank for the purpose of implementing the hedging strategy required by the Hedging Letter and approved by the Security Agent under Clause 25.12 (Accession of Hedging Banks) and, for the avoidance of doubt, including any documents or confirmations entered into between a member of the Group and a Hedging Bank prior to the date of the relevant Hedging Bank Accession Deed and subsequently agreed by the relevant Hedging Bank to be governed by, or referring to, a new ISDA master agreement. Portions of this exhibit have been omitted pursuant to a request for confidential treatment filed with the Securities and Exchange Commission. • Under the terms of the Intercreditor Agreement, all amounts from time to time received or recovered by the Security Agent under the terms of the Super Senior Revolving Credit Facility and related finance documents, the Super Senior Hedging Documents, the Notes or the Guarantee or in connection with the realisation or enforcement of the Transaction Security will be distributed in accordance with the order of priority for such distribution set out in the Intercreditor Agreement.

More Definitions of Hedging Documents

Hedging Documents means each Early Termination Notice, each Expiry Notice and the Hedging Framework and Accession Agreement.

Hedging Documents means any currency swap or interest swap, cap or collar arrangements, future or option contracts or any other derivative instrument or agreement entered into between the Borrower and a Bank in accordance with the Hedging Policy.

Hedging Documents means any ISDA master agreement and other currency or interest hedging agreements or documents in each case in form and substance satisfactory to the Facility Agent and which may be entered into by a member of the Group with a Lender or Affiliate thereof as contemplated in the Hedging Letter.

Hedging Documents means the documents entered into between a member of the Group and a Hedging Bank for the purpose of implementing the hedging strategy required by the Hedging Letter.

Hedging Documents means any agreements entered into from time to time between any member of the Group and any person in relation to the Group’s exposure to floating interest rates or foreign currency exchange rates (and any agreements, confirmations or other documents in any way related to such agreements);
