Grandfathered provision as per arbitration award of May 19, 1997: As at the date of signing of this Agreement, all full time permanent employees who were covered by the former Ottawa Civilian Agreement, and all temporary employees who were hired prior to January 1, 1995 and covered by the former Ottawa Civilian Agreement will remain eligible for the former Ottawa shift premium provisions while required to work shifts. Those provisions are as follows: (a) 12:00 midnight Sunday to 11:50 p.m. Friday
Grandfathered means an individual who was an Employee of Pacific Gas and Electric Company and who has become an Employee of PG&E CORP by reason of a transfer prior to January 1, 2000.

In consideration of such transfer, Buyer agrees not to terminate or materially modify those post-retirement health and life benefit provisions applicable to such grandfathered Transferred Employees and Water Sector Retirees as such provisions are in effect immediately prior to the Closing Date.

Grandfathered means, in reference to equipment or control apparatus, that construction, reconstruction, or modification occurred prior to enactment of N.J.S.A. 26:2C-9.2 on June 15, 1967, or prior to the subsequent applicable revisions to rules and regulations codified at N.J.A.C. 7:27-8 that occurred March 5, 1973, June 1, 1976, April 5, 1985, and October 31, 1994, and no construction, reconstruction, or modification of the equipment or control apparatus has occurred since.
Grandfathered leave in their Reserve Leave Fund (“RLF”) and/or their excess leave accounts are subject to the following terms:
