Examples of French Borrower in a sentence
None of the payments made by or on account of a French Borrower to the Administrative Agent or any Lenders pursuant to the Loan Documents and, as for payments received from or on account from a French Borrower, none of the payments remitted to any Lenders pursuant to the Loan Documents, shall be paid or remitted to an account opened with a financial institution situated in a Non-Cooperative Jurisdiction.
Each Lender may make any Credit Extension to a Borrower through any Lending Office (except that no Lender shall make any Loan to a French Borrower from a Lending Office in a Non-Cooperative Jurisdiction), provided that the exercise of this option shall not affect the obligation of such Borrower to repay the Credit Extension in accordance with the terms of this Agreement.
For the avoidance of doubt, no ROW Borrower and no French Borrower hereunder shall be held jointly and severally liable with any other Obligor hereunder or under any other Loan Document.
In particular, no part of the proceeds of any French Term Loan will be used, directly or indirectly, by any French Borrower to finance or refinance any subscription or acquisition of its own shares to the extent that such financing or refinancing would constitute unlawful financial assistance within the meaning of article L.225-216 of the French Code de commerce.
The proceeds of the French Swingline Loan will be made available by the French Swingline Lender to the French Borrower identified in such notice at an office of the French Swingline Lender by wire transfer to the account of such French Borrower specified in such notice.
