Former Plan definition

Former Plan means any employee benefit plan in respect of which the Customer or a Subsidiary has engaged in a transaction described in Section 4069 or Section 4212(c) of ERISA.
Former Plan means the CPS 1997 Long-Term Incentive Plan, as amended.
Former Plan any employee benefit plan in respect of which the Borrower or a Commonly Controlled Entity could incur liability because of Section 4069 or Section 4212(c) of ERISA.

  • In this regard, the vested portion of such remaining retirement income benefit will be equal to 50% after five (5) years for participation in the Plan and the Former Plan, scaling up by 10% per year to 100% after ten (10) years of such participation.
