If Developer is excused from insuring the Flood Event pursuant to Section 17.1.8, then Developer shall be deemed to have self-insured the Flood Event risk in the amount of the deductible under the most recent Insurance Policy Developer carried for such risk, inflated annually by the increase, if any, in the CPI between the CPI most recently published before January 1 of the last year covered by such Insurance Policy and the CPI most recently published before January 1 of the applicable year.
