Five. If the issue is not resolved at the President/CEO level, then the Association may, within fourteen (14) days of the President's/CEO's decision request that the Medical Center participate in non-binding mediation through the Federal Mediation or Conciliation Service. If the Medical Center does not agree to mediation or if mediation does not result in resolution of the grievance, the Association may, within fourteen (14) days of the Medical Center’s decision not to participate in mediation or within fourteen (14) days of the mediation session, refer the grievance to a neutral party selected from a list of names supplied by the Federal Mediation and Conciliation Service. The decision of the neutral party as arbitrator shall be binding upon the parties and each party shall pay one- half (1/2) of the arbitrator's fee. The arbitrator shall not have authority to add to, modify or detract from the provisions of this Agreement.

Five. The Union and the Employer will have fourteen (14) calendar days to discuss the grievance, hold meetings, and try to come to a mutually agreeable settlement. Within seven (7) calendar days after the end of the specified fourteen (14) day period, Employer will provide Union with a written statement of its position on the grievance. Step Six: If the grievance is not resolved at Step Five, the Union may submit the matter to arbitration within seven (7) calendar days from the date Union receives Employer’s statement.
Five. The time limitations set forth in the article are of the essence of this agreement. Any grievance not timely appealed to step three, shall be deemed to have been settled in accordance with the County’s step two answer. The same shall be true if the grievance is not timely appealed to step four. If the grievance is not timely submitted at step one, or step two, it shall be deemed as being waived. If the grievance is not timely appealed to step three, it shall be deemed to have been settled in accordance with the County’s step two answer. The same shall be true if the grievance is not timely appealed to step four. If the County fails to answer within the time limits set forth in this section, the grievance shall automatically proceed to the next step.
