FCS definition

FCS means first commercial shipment of a production version of a software or hardware product or technology.
FCS means the first sale of any Licensed Product by Licensee or a Sublicensee triggering payment of an Earned Royalty pursuant to this Agreement, following approval of its marketing by the appropriate governmental agency for the country in which the sale is to be made. When governmental approval is not required, “First Commercial Sale” means the first sale in that country.
FCS means, with respect to any royalty, the gross amount invoiced on account of the First Commercial Sale of royalty bearing Licensed Product by Licensee, less the following:

  • The term "Plans and Specifications" means the final plans and specifications for the Enhancements prepared by the Project Team and approved by authorized representatives of the City and FCS.
