Existing Development Approvals definition

Existing Development Approvals means all Development Approvals approved or issued prior to or on the Effective Date. Existing Development Approvals include the approvals set forth in Section 3.1.6 and all other approvals which are a matter of public record prior to or on the Effective Date.

Examples of Existing Development Approvals in a sentence

• City agrees that it shall accept for processing and promptly take action on all applications for Implementing Approvals, provided they are in a proper form and acceptable for required processing in accordance with the Existing Development Approvals and the provisions of this Agreement.

• During the Term of this Agreement, Developer shall be entitled to, and vested with the right to, develop the Project on the Property, subject to the terms and conditions of this Agreement, the Existing Development Approvals, any Subsequent Development Approvals, the Cannabis Business License, Land Use Regulations and State laws.

• In exchange for the vested right to develop pursuant to this Agreement, Developer expressly waives for himself and for any successor thereto, the right to challenge or contest the validity of any condition of approval attached to any entitlement which is a part of the Existing Development Approvals.

• The parties acknowledge that refinement and further development of the Project will require Subsequent Development Approvals and may demonstrate that changes are appropriate and mutually desirable in the Existing Development Approvals.

• If approved, any such change in the Existing Development Approvals shall be incorporated herein as an addendum to Exhibit “C”, and may be further changed from time to time as provided in this Section.

More Definitions of Existing Development Approvals

Existing Development Approvals means (i) the Development Approvals listed on Exhibit J, regardless of when the permits and approvals listed in Exhibit J actually take effect, and (ii) the Project Agreements.

Existing Development Approvals means all Development Approvals approved or issued prior to or on the Entry Date of this Agreement, including but not limited to, a General Plan Amendment, Zone Change, Approval of Specific Plan, Tentative Subdivision Map, and Certification of an EIR.
