Excluded Projects definition

Excluded Projects means the acquisition, leasing, planning, development, construction (including demolition, rehabilitation, renovation and/or expansion of existing buildings) and fit-out (but excluding any long-term and equipment financing thereof) of the Corporate Headquarters and the Distribution Center.
Excluded Projects has the meaning set forth in Section 2.3(a)
Excluded Projects means projects designated as excluded projects by the Company or a Restricted Subsidiary in accordance with the Senior Secured Credit Facilities or any Credit Facility that refinances in whole or in part the Senior Secured Credit Facilities.

Examples of Excluded Projects in a sentence

  • This Section shall not prohibit any transfer of the Excluded Projects to Affiliates of the Borrower or Borrower’s Member.

  • Excluded Projects are those in connection with the exploration of new oil and gas resources or reserves.

  • Notwithstanding the foregoing, and in addition thereto, Buyer shall have a right for remedy against Seller pursuant to the terms of this Agreement which claim is limited to the Excluded Projects only.

  • The Company shall apply all amounts borrowed by it under the Revolving Credit Facilities to pay for the refinancing of existing indebtedness of the Company, the design, development and construction of the Cotai Project and for the general corporate purposes of the Group (including investment in Excluded Subsidiaries, Excluded Projects or Resort Management Agreements).


More Definitions of Excluded Projects

Excluded Projects has the meaning specified in Section 8.5(b).
Excluded Projects means those projects listed on Exhibit A attached hereto and made a part hereof.

Excluded Projects means, individually or collectively, as the context requires, each of (a) the Bridgeport Project, (b) the Pfizer Project, (c) the Riverside Regional Water Quality Control Plant Project, (d) the Santa ▇▇▇▇ Project, (e) until the occurrence of the Triangle Joinder Date, the Triangle Street Project, (f) the UC Irvine Medical Center Project, (g) until the occurrence of the Second Funding Date, the CCSU Project, (h) until the occurrence of the Second Funding Date, the Groton Project, and (i) from time to time after the Closing Date, each Additional Excluded Project.
Excluded Projects means the projects listed in Schedule K (Excluded Projects). "Exclusion Policy" means the European Investment Bank Exclusion Policy as published on the Bank’s website. “Facilities” means, together, Facility A, Facility B and Facility C, and “Facility” means each of them. “Facility A” has the meaning given to it in paragraph (a) of Article 2.2.1 (Facilities). “Facility B” has the meaning given to it in paragraph (b) of Article 2.2.1 (Facilities). “Facility C” has the meaning given to it in paragraph (c) of Article 2.2.1 (Facilities). "FATCA" means: (a) sections 1471 lo 1474 of the Code or any associated regulations or other official guidance; (b) any treaty, law, regulation or other official guidance enacted in any other jurisdiction, or relating to an intergovernmental agreement between the United States and any other jurisdiction, which (in either case) facilitates the implementation of paragraph (a) above;
