Personal Data and Excluded Data (each as defined in Section 5 (Data Protection) below) are excluded from the general definition of “Confidential Information” and the application of this Section (Confidentiality) but are subject to the specific confidentiality and other provisions of Section 5 (Data Protection).
As such, Section 12.2 of the General Terms shall not apply with respect to any Excluded Data that is necessary or required in order for Entrust to provide Identity Proofing to Customer and its Users pursuant to the Agreement, but only to the extent necessary or required.
In addition, Customer represents and warrants that it will not provide or transfer or cause to be provided or transferred to Entrust Datacard any Excluded Data.
Customer recognizes and agrees that: (i) Entrust Datacard has no liability for any failure to provide protections set forth in the Excluded Data Laws or otherwise to protect excluded data; and (ii) Entrust Datacard’s Offerings are not intended for management or protection of Excluded Data and may not provide adequate or legally required security for Excluded Data.

More Definitions of Excluded Data
Excluded Data means: (i) social security numbers or their equivalent (e.g., social insurance numbers), driver license numbers, and health card numbers; (ii) other personal data that would be considered sensitive in nature including information regarding racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data, data concerning health or data concerning a natural person's sex life or sexual orientation;
Excluded Data means: (i) data that is classified, used on the U.S. Munitions list (including software and technical data); or both; (ii) articles, services, and related technical data designated as defense articles and defense services;
Excluded Data means: (i) data that is classified, used on the U.S. Munitions list (including software and technical data) or both; (ii) articles, services, and related technical data designated as defense articles and defense services; and (iii) ITAR (International Traffic in Arms Regulations) related data; and (iv) other personally identifiable information that is subject to heightened security requirements as a result of Customer’s internal policies or practices or by law. Customer acknowledges that products and services provided under the CSA are not designed to process, store, or be used in connection with Excluded Data. Customer is solely responsible for reviewing data that will be provided to or accessed by Suppliers to ensure that it does not contain Excluded Data.
Excluded Data means: (i) data that is classified, used on the U.S. Munitions list (including software and technical data); or both; (ii) articles, services, and related technical data designated as defense articles and defense services; (iii) ITAR (International Traffic in Arms Regulations) released data; and (iv) personally identifiable information that is subject to heightened security requirements as a result of Customer’s internal policies or practices, industry-specific standards or by law.
Excluded Data refers to: (i) social security numbers or their equivalent (e.g., social insurance numbers), driver license numbers, biometric data, health card numbers and other health-related information; (ii) other Personal Data that would be considered sensitive in nature including without limitation of a “special category of data” under EU Directive 95/46; and (iii) data regulated under the Health Insurance Portability and Accountability Act or the Xxxxx- Xxxxx-Xxxxxx Act, or the Payment Card Industry Data Security Standards or similar laws or regulations in place now or in the future in the applicable jurisdiction (collectively, the “Excluded Data Laws”). CUSTOMER (AND TENANTS) RECOGNIZE(S) AND AGREE(S) THAT: (i) ENTRUST DATACARD HAS NO LIABILITY FOR ANY FAILURE TO PROVIDE PROTECTIONS SET FORTH IN THE EXCLUDED DATA LAWS OR OTHERWISE TO PROTECT EXCLUDED DATA; AND (ii) THE SERVICE IS NOT INTENDED FOR MANAGEMENT OR PROTECTION OF EXCLUDED DATA AND MAY NOT PROVIDE ADEQUATE OR LEGALLY REQUIRED SECURITY FOR EXCLUDED DATA.
Excluded Data means any Know-How, other than Safety Data, generated by a Party in the conduct of Development activities in accordance with a Development Collaboration Proposal where the other Party has declined to participate in such Development Collaboration Proposal and has not paid the Buy-In Amount in accordance with Section 5.4.2(b)(iv).
Excluded Data means Protected Health Information as that term is defined in The Health Insurance Portability and Accountability Act of 1996, as amended, and the regulations promulgated thereunder (HIPAA).
