Excluded Activity means any relevant activity (other than sawing) which, ignoring any sawing carried on at the works, would be unlikely to result in the release into the air of any substance in paragraph 6(3) of Part 1 of this Schedule in a quantity capable of causing significant harm;

• Each of Vantage, Provider Partner, or Profit Stars reserves the right to reject any proposed Customer account or to refuse to process a transaction for a Customer that each of Vantage, Provider Partner, or Profit Stars deems, in its respective sole discretion, may use the processing Services in conjunction with any Excluded Activity.

• It is not taking part in or financing any activity, production, use of, trade in, distribution of, or otherwise involved in any Excluded Activity except that, in the case of tobacco, the Borrower shall use all reasonable efforts not to provide funding to clients engaged in such activities and shall ensure that in all events, the Party’s aggregate funding to such clients shall not at any time exceed two per cent.

• Building acquisition where physical improvements, if any, will be limited to those listed in Excluded Activity 3.1 – 3, below.

• The Company therefore agrees that the Consultant shall permit such Employee to receive and retain for its own benefit any commissions, fees and/or other compensation due to such Employee now or in the future from these Prior Contacts and for the Prior Services as set forth on Exhibit A, whether or not otherwise a Covered Transaction or otherwise an "Excluded Activity".

More Definitions of Excluded Activity

Excluded Activity means services relating to an Adams Product that are performed by employees of Adams in the ordinar▇ ▇▇▇rse of business or product sales and marketi▇▇ ▇▇rvices set forth in Section 1(c)(vi) performed by a Major Pharmaceutical Enterprise that acquires exclusive rights to market the relevant Adams Product. For the avoidance of doubt, Excluded Activities, as th▇▇ ▇▇rm relates to a Major Pharmaceutical Enterprise or its Affiliates, do not include any of those Commercial Outsource Activities set forth in Section 1(c) other than Section 1(c)(vi).

Excluded Activity means any of the following: (a) alteration or repairs by anyone other than Roadmaster, (b) misuse, abuse, or improper maintenance, (c) commercial use, (d) Acts of God (including without limitation hurricanes, tornadoes, floods, or other severe weather or natural phenomena), (e) failures due to products, services, or equipment supplied by anyone other than Road- master, and (f) any other treatments, uses, or installations for which the product was not intended.
