The Purchase Contracts shall not entitle the Holder to any of the rights of a holder of the Common Shares or other Exchange Property, except as provided by the Purchase Contract Agreement.
Each Fixed Settlement Rate shall be determined based upon the Applicable Market Value of a unit of Exchange Property that a holder of one Common Share would have received in such Reorganization Event.
