Excess Consumption definition

Excess Consumption means the consumption of electrical current (including current in excess of 120 volts), water, heat or cooling in excess of that which would be provided to the Premises were the Premises to be (i) built out with the Building Standard Improvements only: (ii) used as general office space during the foregoing business hours: and (iii) equipped only with typewriters, desk calculators, personal computers, dictation equipment and copying machines with power requirements of 30 amperes or less. If Tenant shall require water, heating, cooling, air or electric current which will result in Excess Consumption. Tenant shall first procure the consent of Landlord to the use thereof, and Landlord may cause separate meters to be installed to measure Excess Consumption or establish another basis for determining the amount of Excess Consumption. Tenant covenants and agrees to pay for the cost of the Excess Consumption based on Landlord’s cost, plus any additional expense incurred in installing meters or keeping account of the Excess Consumption, at the same time as payment of the Base Rent is made. Tenant further agrees to pay Landlord the cost, if any, to upgrade existing mechanical, electrical, plumbing and air facilities, if required to provide Excess Consumption, upon receipt of a statement therefor. Excess Consumption costs will not be an Operating Cost for purposes of Section 10. Landlord shall not be liable in damages or otherwise for any failure or interruption of any utility service being furnished to the Premises, unless the same shall have been caused by Landlord’s negligence and Landlord shall have been unable to cure such failure or interruption within 48 hours following notice from Tenant, in which event Tenant as its exclusive remedy for such failure or interruption shall be entitled to an abatement of Base Rent for the number of days Tenant is prohibited from operating or conducting its business and is closed to the public. In no event shall any such failure or interruption entitle Tenant to terminate this Lease or, except to the extent of any abatement permitted pursuant to this Section 13, withhold any rent or any other sums due pursuant to the terms of this Lease.
Excess Consumption is defined in Section 5 of Article I.
Excess Consumption means, with respect to a Site Service to which a Contract Quantity applies, any volumes or levels of that Site Service in excess of the Customer’s Contract Quantity.

Examples of Excess Consumption in a sentence

  • If Tenant shall require water, heating, cooling, air or electric current which will result in Excess Consumption, Tenant shall first procure the consent of Landlord to the use thereof, and Landlord may cause separate meters to be installed to measure Excess Consumption or establish another basis for determining the amount of Excess Consumption.

  • Tenant further agrees to pay Landlord the cost, if any, to upgrade existing mechanical, electrical, plumbing and air facilities, if required to provide Excess Consumption, upon receipt of a statement therefor.

  • Landlord may, from time to time, invoice Tenant for Metered Electrical Expenses (as well as any Excess Consumption Costs determined by a reputable consultant) and Tenant shall, within ten (10) days after receiving an invoice therefor, pay Landlord the amount of the Metered Electrical Expenses (and/or, as applicable, any Excess Consumption Costs determined by a reputable consultant) covered by such invoice.

  • Excess Consumption costs will not be a Direct Cost for purposes of Article 4.

  • However, to the extent Excess Consumption is provided to a Member Agency then the Member Agency shall be subject to Capacity Lease Charges as defined by Schedule VI-5.

Excess Consumption is defined as consumption of electrical current (in excess of 110 volts), water, heat, cooling or compressed air (if compressed air is furnished by Landlord) in excess of that which would be provided to the Premises were the Premises to be (A) built with Building Standard Improvements only; (B) used as general office space during normal hours; and (C) equipped only with word processors, personal computers, typewriters, desk calculators, dictation equipment and copy machines each with power requirements of 15 amperes or less. Tenant agrees to pay Landlord any excess of the sum of (i) through (vii) minus the Tenant Buildout Allowance within ten (10) days after receipt of a statement therefor from Landlord. If the Tenant Buildout Allowance exceeds the sum of (i) through (vii), Landlord shall retain the surplus and Tenant shall not be entitled to any portion of such surplus. Any failure of Tenant to pay said costs when due shall constitute a default under the terms of the Lease in like manner as the failure to pay rental when due.
Excess Consumption means (a) in the case of tenement in respect of which general water rate is payable, quantity of water ascertained by tenement in excess of such monthly allowance may be prescribed and,
Excess Consumption means the consumption of electrical current (including current in excess of 120 volts), water, heat, cooling, or compressed air (if compressed air is furnished by Landlord) in excess of that which would be provided to the Premises if the Premises were to be used as a general medical office during reasonable business hours on weekdays, equipped only with reasonable and customary amounts of computers, office equipment, copying machines, and medical appliances with power requirements of 30 amperes or Jess. If Landlord reasonably believes that Tenant’s proposed or actual consumption of electricity is in excess of standard consumption for general medical office use, or requires the installation of additional electrical capacity to the Building in excess of that which is reasonably necessary for general medical office use, as may occur where Tenant has installed or proposes to install MRI, X-Ray or other equipment requiring heavy electrical power consumption, then Landlord may charge Tenant directly for such excess services, and Tenant shall pay the entire cost of purchasing, installing and maintaining meters, panels, wiring and other items required to accommodate excess services to Tenant within 30 days of receipt of a written bill from Landlord.
