If the Planning Director makes a determination, based on demonstrated demand by drivers at the Project, that some or all of the EV Ready Parking Spaces already equipped with electric vehicle charging stations are not needed, then Developer shall be allowed to remove such electric vehicle charging stations.
Notwithstanding the foregoing, to the extent permissible by law, Developer shall, within sixty days of Developer’s receipt of a request from a tenant and to the extent such spaces are not already leased to tenants who own or long-term (2 years or more) lease electric vehicles, make any EV Ready Parking Spaces equipped with electric charging stations available to tenants who then own or long-term (2 years or more) lease an electric vehicle on a first-come first-served basis.
