IN NO EVENT WILL NEW ERA BE LIABLE TO DISTRIBUTOR OR ANY OTHER PERSON FOR ANY DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF THE USE OR INABILITY TO USE ANY OF THE PRODUCTS, EVEN IF NEW ERA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.
NEW ERA DOES NOT ASSURE UNINTERRUPTED OPERATION OF THE PRODUCTS OR THAT THE PRODUCTS WILL MEET ANY PARTICULAR REQUIREMENTS OF DISTRIBUTOR OR ITS CUSTOMERS.
If I no longer wish to be considered a qualified trainer, I shall inform the ERA Safety Training Team without delay and this Agreement will be terminated upon confirmation by the Agency.
The ERA looks into the facts and makes a decision based on the merits of the case, not on legal technicalities.
EXCEPT AS SET FORTH IN THIS SECTION 8, NEW ERA MAKES NO WARRANTIES, EITHER EXPRESS OR IMPLIED, REGARDING ANY OF THE PRODUCTS, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FOR A PARTICULAR PURPOSE.
