Environmental Reports definition

Environmental Reports means “Phase I Environmental Site Assessments” as referred to in the ASTM Standards on Environmental Site Assessments for Commercial Real Estate, E 1527-05 (and, if necessary, “Phase II Environmental Site Assessments”), prepared by an independent environmental auditor approved by Lender and delivered to Lender in connection with the Loan and any amendments or supplements thereto delivered to Lender, and shall also include any other environmental reports delivered to Lender pursuant to this Agreement and the Environmental Indemnity.

Environmental Reports shall have the meaning set forth in Section 12.1.

Environmental Reports means each and every “Phase I Environmental Site Assessment” (and, if applicable, “Phase II Environment Site Assessment”) as referred to in the ASTM Standards on Environmental Site Assessments for Commercial Real Estate, E 1527-2000 and an asbestos survey, with respect to each Mortgaged Property, prepared by one or more Environmental Auditors and delivered to Lender and any amendments or supplements thereto delivered to Lender.

Examples of Environmental Reports in a sentence

• The City shall be responsible at its sole expense for remediating all of the Known Environmental Conditions and performing all of the Response Actions therefor, as currently identified in the Environmental Reports and/or as subsequently determined or modified.

• The Parties acknowledge that the Environmental Reports may reveal certain existing Environmental Conditions (the "Known Environmental Conditions") at the Project Site and the possibility for certain Response Actions in connection therewith.

• The City shall make available for review by the Project Developer at all reasonable times copies of all of the environmental reports, remediation plans, and other matters described on Exhibit "F" attached hereto (together, the "Environmental Reports").

Environmental Reports shall have the meaning set forth in Section 4.1.39 hereof.

Environmental Reports means any and all written analyses, summaries or explanations, in the possession or control of the Company or the Company Subsidiary, prepared for the purpose of analyzing or assessing (a) any Environmental Conditions in, on or about the properties of the Company or the Company Subsidiary or (b) the Company's or the Company Subsidiary's compliance with Environmental Laws.

Environmental Reports means those environmental reports and studies relating to the Land as are listed on Exhibit B attached hereto.

Environmental Reports means, with respect to each Individual Property, environmental audit report(s) (i) prepared by a reputable environmental Engineer approved by Lender in Lender’s discretion, (ii) addressed to or permitted by such environmental Engineer to be relied upon by Lender (iii) prepared based on a scope of work determined by Lender in Lender’s discretion, and (iv) in form and content acceptable to Lender in Lender’s discretion, together with any amendments or supplements thereto delivered to Lender.

Environmental Reports shall have the meaning given such term in Section 2.5.
