More Definitions of environmental evaluation

environmental evaluation means an evaluation of the environmental impact of a proposed land development, conducted in accordance with the integrated environmental management guidelines which are from time to time issued or amended by the Department of Environment Affairs and Tourism;
environmental evaluation means (i) the completion of a Phase I ESA and environmental compliance review of the Site, the Facility and the Equipment and (ii) if (A) the Phase I ESA identifies RECs or environmental compliance issues related to the operation of the Site, and (B) the Environmental Consultant recommends further evaluation or investigation in addition to the Phase I ESA or environmental compliance review, then (iii) Lessor or Owner shall engage an Environmental Consultant to complete a Phase II ESA or further compliance evaluation. Copies of any Phase I ESA or Phase II ESA reports generated as part of the Environmental Evaluation shall be provided to and may be relied upon by the other party. If an Adverse Environmental Condition (other than a minor noncompliance or de minimis and surficial Release to a non-pervious surface or to soil) is identified, the Company or PGI will pay for the Environmental Evaluation; to the extent not specified in the Operative Documents, Owner shall pay for the Environmental Evaluation.
environmental evaluation means a Phase I Environmental Site Assessment (an "ESA") and a limited Phase II ESA ("Baseline Study") of the Site. The Environmental Consultant shall prepare a scope of work for the Baseline Study, acceptable to Lessor, which scope of work shall be sufficient to establish the presence or absence of soil contamination on the Site. In the event that the Phase I ESA identifies recognized environmental concerns and the Environmental Consultant recommends further evaluation and investigation of the Site in addition to the Baseline Study, the Construction Agent will retain a qualified and competent environmental consultant (who is also acceptable to Lessor) to undertake, as soon as reasonably practicable, a Phase II ESA. In the event that the Phase I ESA identifies recognized environmental concerns and the Environmental Consultant does not recommend further evaluation and investigation of the Site, Lessor may request, which request must be based on, and reasonably related to, the findings and conclusions of the Phase I ESA, that Lessee retain a qualified and competent environmental consultant (who is also acceptable to Lessor) to conduct a complete or limited Phase II ESA, in addition to the Baseline Study. Copies of any Phase I ESA or Phase II ESA reports shall be provided to Lessor and any such evaluations shall be at Lessee's expense.
environmental evaluation means that limited review of higher-risk operational environmental practices of the Incumbent Companies conducted on behalf of the Port prior to the Commencement Date of the Lease.
environmental evaluation has the meaning set forth in Section 5.11.

environmental evaluation means activities undertaken to determine if a release has occurred, if the release poses a significant threat to human health or the environment or if additional remedial actions may be required at the site. “Environmental evaluation” does not include feasibility studies or actions taken to prevent, minimize or mitigate damage to human health or the environment from the release of a hazardous substance.
