Eligible location definition

Eligible location means an unserved location or underserved location.
Eligible location means one of the addresses in the United States of America at which the Borrower maintains, keeps or stores Inventory, as listed in the Security Agreement executed and delivered by the Borrower and the Bank in connection with the Facility, and, if such location is leased by the Borrower, for which the Bank has received a landlord’s waiver acceptable to the Bank. The Borrower and the Bank may agree jointly to add other addresses of the Borrower to such list at any time by executing and delivering a substitute list of addresses under said Security Agreement. The Bank may in its discretion at any time determine that any address on such list shall no longer be an Eligible Location, by giving written notice of such determination to the Borrower.
Eligible location on an ML Adjustment Date, means any Mr. Lube Location that is not included in the ML Royalty Pool on such date and has been open for business since July 1 of the previous ML Reporting Period; provided, in the case of a Non-Flagship Location, that the premises license or lease in respect of such Non-Flagship Location expires no less than 8.5 years after such ML Adjustment Date, excluding renewal rights that are not at Mr. Lube’s option.

Eligible location means land and improvements that are located in a rural area. “Eligible location” includes a location that has not formerly been used for industrial purposes.

Eligible location means a building designated by Wam!Net at which a Wam!Net customer is located that meets all of the following criteria: (i) it is within the reliable radio range of a then-existing Winstar hub; (ii) it has verified (or creatable, with good faith efforts by Winstar), line of sight without frequency interference; (iii) the site has been visited by Winstar personnel or otherwise verified as, in Winstar's reasonable opinion, able to be built-out utilizing outdoor unit space, power, security, verified riser and any other necessary build-out elements; and (iv) Winstar has or may acquire all necessary roof rights.
