Eligible Class Member definition

Eligible Class Member means a Settlement Class Member who timely submits a Claim Form or Electronic Claim Form.
Eligible Class Member is a Settlement Class Member who has submitted a Valid Claim Form and whose eligibility has not been challenged by the Defendant within ninety (90) days of the Claim Form Submission Date.
Eligible Class Member means each General Class Member, Overtime Sub-Class Member, and Meal and Rest Period Settlement Sub-Class member who timely and properly completes in full, signs under penalty of perjury, and submits the Forms, in accordance with the requirements of the Preliminary Approval Order.

  • For purposes of making this determination, a Settlement Allocation Score shall be calculated for each quarter during the Class Period, which shall be the sum of 15 points (if the Eligible Class Member had an Active Account at the end of the quarter) plus 0.0020 points for every dollar invested by the Eligible Participant in MIO Funds at the end of the quarter (up to a maximum of 300 points).

  • Upon the expiration of one hundred twenty (120) days from the date of mailing of the check, the check will become void, and the Eligible Class Member shall not be entitled to any payment.


More Definitions of Eligible Class Member

Eligible Class Member means any Current Owner or Former Owner who is entitled to receive a payment from the Net Settlement Amount under the Plan of Allocation. As described further below, the Plan of Allocation assumes that any payment will be made only to the Current Owner of a Class Member’s royalties and overriding royalties for CBM from the Fruitland formation in the San Juan Basin during the Class Period who did not opt out of the Class absent a determination that a Former Owner is entitled to a portion of such payment.
Eligible Class Member means a Class Member who has submitted a timely and proper Claim Form in accordance with the requirements set forth in this Agreement.
Eligible Class Member means each Class Member who does not opt out of the Settlement in accordance with the requirements of this Agreement and the Preliminary Approval Order.
Eligible Class Member means each Class Member whose electronic Claim Form is approved by the Administrator before the Claims Bar Date;
