Development Completion definition

Development Completion means the earlier of (a) twelve (12) months after substantial completion of all improvements (other than tenant improvements of unoccupied space) related to the development of such Property and (b) such time as Construction-in-Progress achieves an Occupancy Rate of at least eighty percent (80.0%).
Development Completion means the moment the required building/ development permit conditions and requirements have been met for the purposes of the development permit application and/ or the final inspection reports have been received (as required for the project).
Development Completion means substantial completion of the Development, as evidenced by the issuance of a temporary or permanent certificate of occupancy.

  • Notwithstanding anything herein to the contrary, at any time after the Contract Date but prior to issuance of the Development Completion Notice, either Party may immediately terminate this Agreement upon Notice to the non-terminating Party.

  • Where there is an adjustment to the Substantial Completion Date, the Long Stop Development Completion Date shall be equally adjusted on a day for day basis; provided, however, that Contractor shall use all commercially reasonable efforts to avoid the need for an adjustment to the Long Stop Development Completion Date by accelerating or resequencing the Work, the costs of which shall be dealt with in accordance with Section 5.4 below.
