Deadly force definition

Deadly force means any use of force that creates a substantial risk of causing death or serious bodily injury, including, but not limited to, the discharge of a firearm.
Deadly force means any force that carries a substantial risk that it will proximately result in the death of any person.
Deadly force means physical force that a person uses with the intent of causing, or that a person knows to create a substantial risk of causing, death or serious bodily injury. Except as provided in section 101, subsection 5, intentionally, knowingly or recklessly discharging a firearm in the direction of another person or at a moving vehicle constitutes deadly force.

  • Deadly force is deployed by a department member, regardless of whether injury results.

  • Deadly force may be used only when lesser means have been exhausted or are unavailable, the risk of injury to innocent persons or bystanders is not increased by the use of deadly force, and deadly force is the minimum force necessary to prevent death or serious injury.
