In instances of immediate termination due to serious misconduct, BDT will provide written reasons for the decision and ensure the Contractor has the right to a post-deactivation review, in compliance with Section 14(3) of the Digital Labour Platform Deactivation Code.
Deactivation, suspension or termination shall be without prejudice to any other rights or remedies a Party may be entitled to in law or under the Contract and shall not affect any accrued rights or liabilities of either Party nor the coming into force or the continuance in force of any provision of the Contract, which is expressly or by implication intended to come into or continue in force on or after such termination.

BDT will not enforce permanent deactivation unless the Contractor has been given an opportunity to respond in writing and be heard, in line with Section 14 of the Fair Work (Digital Labour Platform Deactivation Code) Instrument 2024.
BDT will consider any such request in accordance with its obligations under the Digital Labour Platform Deactivation Code.
