Dashboard Technology Limited shall not be responsible for any loss, destruction, alteration or disclosure of the Customer Data caused by any third party (except those third parties sub-contracted by Dashboard Technology Limited to perform services related to the Customer Data maintenance and back-up).
If the Services do not conform with the foregoing undertaking, Dashboard Technology Limited will, at its expense, use reasonable commercial endeavours to correct any such non-conformance promptly, or provide the Customer with an alternative means of accomplishing the desired performance.
The Customer shall indemnify and hold Dashboard Technology Limited harmless from and against all claims, actions, proceedings, losses, damages, costs or expenses which Dashboard Technology Limited may incur or for which it may become liable in respect of any failure of the Customer Data to be reliable, accurate, of good quality or legal.
Dashboard Technology Limited gives no warranty in respect of the legality, reliability, integrity, accuracy or quality of the Customer Data (regardless of whether or not Dashboard Technology Limited uploaded it onto the system).
The only processing that Dashboard Technology Limited is authorised to do is listed in Appendix A by the Customer and may not be determined by Dashboard Technology Limited.
