Customer Product definition

Customer Product means any pharmaceutical product owned, controlled or sold by Customer, its Affiliates or Customer Licensees that incorporates or is derived from a Product;
Customer Product means (i) for EMB-EPS Products, a product identified on the Order which will be developed and/or manufactured by Customer or an Authorized Agent on behalf of Customer or (ii) for EMB-IES Products, a moving machinery or any component thereof, excluding ultra-hazardous use-cases (including aerospace and aviation, nuclear power, chemical and/or biological reactors, petrochemical, military), but including military marine transportation vessels.
Customer Product has the meaning given such term in the recitals to this Agreement.

  • If the Software supports multiple platforms, or if You receive the Software bundled with other Software, the total number of devices on which all versions of the Software is installed may not exceed the Customer Product Entitlement Definitions.

  • ChannelAdvisor may access, monitor, remove content within, or disable Customer access to the Technology if (a) a Network Site or, in the case of the Shoppable Media Module, a Reseller, requests that ChannelAdvisor do so, (b) ChannelAdvisor, in its sole discretion, believes it may incur liability because of Customer Product Information, (c) ChannelAdvisor is required to do so by law, government order or other legal process, or (d) to enforce the terms of this Agreement.

  • This Agreement, which includes Appendix A, Appendix B, Appendix C and each executed Customer Product Agreement Extension constitutes the entire agreement between the Parties concerning the subject matter hereof and supersedes any prior agreements, representations, statements, negotiations, understandings, proposals or undertakings, oral or written, with respect to the subject matter expressly set forth herein.

  • Parent shall make available the latest versions of this Agreement and Customer Product Agreement Extensions in the Customer Control Panel or on the Parent Website.

  • ChannelAdvisor may access, monitor, remove content within, or disable Customer access to the ChannelAdvisor Platform or Services if (a) a Network Site requests that ChannelAdvisor do so, (b) ChannelAdvisor, in its sole discretion, believes it may incur liability because of Customer Product Information, (c) ChannelAdvisor is required to do so by law, government order or other legal process or (d) to enforce the terms of this Agreement.


More Definitions of Customer Product

Customer Product means the goods and or services that Customer makes available for sale, or use through the Customer Site.
Customer Product means any medical device, implant, medical instrument, or similar item intended for use inside of or in contact with a human body that contains PEEK and is sold, offered for sale, or distributed by a Customer. For the avoidance of doubt, Customer Product includes Custom Components and Jointly Developed Products. For the further avoidance of doubt, other than Custom Components and Jointly Developed Products, products with different part numbers, SKUs, or other differentiating identifiers are distinct Customer Products, even if they have identical indications for use.
Customer Product means a product containing or comprising a combination of Customer Vaccine and Dynavax Adjuvant supplied by Dynavax hereunder (whether such Dynavax Adjuvant is formulated with the Customer Vaccine in the same vial or separately from the Customer Vaccine in an accompanying vial).
Customer Product means a therapeutic product or product candidate comprising one or more Collaboration Strains. For clarity, a Customer Product of a Program that has been Abandoned shall cease to be a Customer Product.
Customer Product means a digital printer, printing system or printing subsystem, including a Mechanism and a Printhead, designed, manufactured or marketed by or on behalf of Customer, on a retail, distribution or OEM sales basis, the Printhead(s) in which have been purchased from Spectra.
Customer Product means Customer's proprietary products as listed in the applicable Sales Order.
Customer Product means any and all products, materials, or services developed, marketed, sold, or provided by or for Customer (or by or for its customer) through use of, in conjunction with, or incorporating the Goods. “Documentation” means user manuals, written protocols or other written documentation provided by Illumina under this Agreement related to the use and/or maintenance of the Goods. “Electronic Order” means an order placed by Customer utilizing Illumina’s electronic commerce system (e.g., iCom). “Facility” means the Customer facility located at the shipping address identified on the Quotation, on the Order Confirmation, or during the Electronic Order, as applicable. “Final Investment” means either the amount designated (i) as “Final Investment” on the Quotation, (ii) in the Electronic Order, or (iii) in the Order Confirmation, as applicable. ”FDA” means the U.S. Food and Drug Administration. “Goods” means any and all of the GPR Consumables and other items provided hereunder. “GPR Consumables” means any or all reagents or materials provided hereunder and labeled as or otherwise designated as a General Purpose Reagent as defined by FDA including the VeraCode GPR Beads. “Intellectual Property Rights” means all rights in patents, copyrights, trade secrets, know-how, trademark, service xxxx and trade dress and other intellectual property, current or future, under the laws of any jurisdiction, together with all rights in applications therefor and registrations thereto. “Order Confirmation” means a sales order confirmation document provided by Illumina. “Quotation” means a written quotation provided by Illumina to Customer. “Specifications” means the written specifications for the Goods that may be contained in the Quotation, Documentation, and/or other written materials provided to Customer by Illumina and in effect on the earlier of the date of the Quotation or date Customer places the order for such Goods. “VeraCode GPR Beads” refers to any or all of Illumina’s VeraCode™ Universal Capture Beads labeled as a General Purpose Reagent and VeraCode™ Carboxyl Beads labeled as a General Purpose Reagent.
