For purposes of this Section 4, all references to the “Company” shall be deemed to refer to the Company and the Current Subsidiaries unless the context clearly requires otherwise.
The Guaranty, dated or to be dated on or prior to the Closing Date, made by each of the Current Subsidiaries in favor of the Banks and the Agent pursuant to which such entities jointly and severally guarantee to the Banks and the Agent the payment and performance of the Obligations in form and substance satisfactory to the Agent.

Each Party, on behalf of itself and its Current Subsidiaries, acknowledges that it has been fully informed by its counsel concerning the effect and import of this Agreement under California Civil Code Section 1542 and other requirements of law.
