Examples of Cure Period in a sentence
If at any time an Event of Default with respect to a Party (the “Defaulting Party”) has occurred and is then continuing, after giving effect to the applicable Cure Period, the other Party (the “Non-Defaulting Party”) may, by not more than twenty (20) days’ notice to the Defaulting Party specifying the relevant Event of Default, designate a day not earlier than the day such notice is effective as an Early Termination Date in respect of this Agreement.
Upon replenishment or furnishing of a fresh Performance Security, as the case may be, as aforesaid, the Contractor shall be entitled to an additional Cure Period of 30 (thirty) days for remedying the Contractor’s Default, and in the event of the Contractor not curing its default within such Cure Period, the Authority shall be entitled to encash and appropriate such Performance Security as Damages, and to terminate this Agreement in accordance with Article23.
Failure by the Party to comply with or perform any agreement to be complied with or performed by the Party in accordance with this Agreement if such failure is not cured at the end of the applicable Cure Period; Performance Security.
If the nature of the alleged Major Default is such that it cannot reasonably be cured within the applicable Cure Period, Owner shall not be deemed to be in Major Default if it has commenced efforts to cure the Major Default within the applicable Cure Period and continues to diligently pursue completion of the cure.
In the event of a material breach by Xxxxx, and Xxxxx is unable to cure within the Cure Period, Flock will refund Customer a pro-rata portion of the pre-paid fees for Services not received due to such termination.
