The Company is in compliance in all material respects with, and each of the Company Plans and any related trust, insurance contract or fund is and has been established, maintained, funded, operated and administered in all material respects in accordance with its respective terms and is in compliance in all material respects with, all Applicable Laws, including ERISA, the Code, and COVID-19 Relief.
Tenant shall immediately report to Building property management if ▇▇▇▇▇▇ becomes aware that any individual present in the Premises or present in the Building or Property by, through, or on behalf of Tenant days: (a) had a confirmed case of COVID-19 at the time of such visit or within 14 days prior thereto, or (b) has since been diagnosed with COVID-19.
Landlord shall have the right, but not the obligation, to (a) screen any person seeking entrance to the Building for symptoms of contagious disease (including but not limited to COVID-19), which screening may include, without limitation a temperature scan, and (b) deny entry to the Building to any person exhibiting symptoms of contagious disease (including but not limited to COVID-19), including those persons exhibiting an elevated body temperature.
The requirements of Part 6 of Subtitle B of Title I of ERISA, Section 4980B of the Code, COVID-19 Relief (as hereinafter defined) or similar state law (“COBRA”) have been met in all material respects with respect to each such Company Plan that is an employee welfare benefit plan (as defined in Section 3(1) of ERISA).
Within the Premises, Tenant shall observe and comply with any and all federal, state, and local authorities with jurisdiction over the Building or the Premises or the operation of Tenant’s business therein, including, without limitation, those public health requirements and guidelines issued in connection with the COVID-19 pandemic (collectively, the “Public Health Guidelines”).
