Covered Incident definition

Covered Incident means any instance in which any United States federal, state, or local law or regulation requires Respondent to notify any U.S. federal, state, or local government entity that information collected or received, directly or indirectly, by Respondent from or about an individual consumer was, or is reasonably believed to have been, accessed or acquired without authorization.
Covered Incident means any incident that results in a Covered Business notifying, pursuant to a statutory or regulatory requirement, any U.S. federal, state, or local government entity that information of or about an individual consumer was, or is reasonably believed to have been, accessed, acquired, or publicly exposed without authorization.
Covered Incident in respect of section A & B means the recall, removal, recovery of possession or control, or disposal of "Your Product"(s) from a distributor, purchaser, or user of "Your Product"(s) because the use or consumption of "Your Product"(s) has resulted in "Bodily Injury" or "Property Damage", or poses actual and imminent danger of resulting in "Bodily Injury" or "Property Damage"

Examples of Covered Incident in a sentence

  • Should treatment of an Incident continue under this Policy, the Deductible would only apply to the Covered Incident during the Policy period in which the date of loss occurred, as shown on the Declarations Page.

  • Coverage is subject to any Per Incident Copay, if elected, Coinsurance or Policy Annual Deductible, as specified in the Policy, and is up to the Annual Maximum Benefit or Covered Incident Limit, as shown on Your Declarations Page.

Covered Incident means any instance of a violation of Section I, II, or III of this Order.
Covered Incident means any instance in which any U.S. federal, state, or local law or regulation requires Defendant to notify any U.S. federal, state, or local government entity that Personal Information collected or received, directly or indirectly, by Defendant from or about an individual consumer was, or is reasonably believed to have been, accessed or acquired without authorization, and the incident affects at least 250 U.S. consumers.
Covered Incident means any instance in which Respondent has verified or otherwise confirmed that the Covered Information of 500 or more Users was or was likely to have been accessed, collected, used, or shared by a Covered Third Party in violation of Respondent’s Platform Terms.
Covered Incident means any instance affecting 250 or more Users in which: (1) any United States federal, state, or local law or regulation requires Respondent to notify any U.S. federal, state, or local government entity that information collected or received, directly or indirectly, by Respondent from or about an individual consumer was, or is reasonably believed to have been, accessed or acquired without authorization; or (2) individually identifiable Covered Information collected or received, directly or indirectly, by Respondent, was, or is reasonably believed to have been, accessed, acquired, or publicly exposed without authorization. “Covered Incident” does not include instances where the only unauthorized access, acquisition, or exposure was due to a User communicating through Respondent’s services (e.g., public tweets, protected tweets, retweets, or direct messages) information that was obtained from sources other than Respondent.

Covered Incident refers to the (a) mechanical or electrical breakdown after the one-year manufacturer warranty expires, (b) accidental damage from handling as a result of normal use, or (c) the standard battery’s failure to hold an electrical charge in accordance with the applicable performance threshold, except as limited or excluded elsewhere in this contract; (7) “replacement device” refers to a NEW, REFURBISHED OR REMANUFACTURED PRODUCT OR A PRODUCT OF EQUAL OR SIMILAR FEATURES AND FUNCTIONALITY THAT PERFORMS TO THE FACTORY SPECIFICATIONS OF THE ORIGINAL COVERED DEVICE; and (8) “program” means the program described in this Plan.
