COTS Software means Service Provider Software and Third Party Software (including open source software) that the Service Provider makes generally available commercially prior to the date of signature of this Contract (whether by way of sale, lease or licence) on standard terms which are not typically negotiated by the Service Provider save as to price.

COTS Software means commercially available “off-the-shelf” Software licensed to any Acquired Corporation in object code form for an aggregate license fee of no more than $25,000 per year.

More Definitions of COTS Software

COTS Software means generally available, commercial, off-the-shelf software available on standard terms, the source code of which has not been modified or customized by or for the Companies or the Sellers and is licensed to a Company or a Seller pursuant to a Contract that does not require any future payment, including any applicable maintenance and support fees, of more than $2,000 per user per year.

COTS Software means commercially available non-custom software or hosted-service or software-as-a-service platforms, that are made available for internal use by any Acquired Company in executable form on standard, non-negotiated terms (excluding pricing and payment terms) involving payments from any Acquired Company for less than $100,000 in the aggregate.

COTS Software means commercially available specialized software designed for specific applications (such as finance, administration, management information system, legal, invoicing/ billing, statistical analysis, etc.) that can be used with little or no modification.

COTS Software means all or any portion of Esri's proprietary software technology accessed or downloaded from an authorized Esri website or delivered on any media, in any format, including backups, updates, service packs, patches, hot fixes, or permitted merged copies, available under license to the general public.

COTS Software means software that is licensed to an Acquired Company under a standard-form, non-negotiated license agreement and that is generally commercially available on non-discriminatory terms.

COTS Software means generally commercially available binary software code that has not been customized for use by Seller and that has been licensed under standard commercial license agreements.
