Direct Purchaser Plaintiff(s) must submit a written certification to the DENSO Defendants by the sixty (60) day deadline that affirms that the Direct Purchaser Plaintiff(s) have not retained any copies, abstracts, compilations, summaries or other form that reproduces or captures any of the Cooperation Materials related to the Released Part.
Settling Defendants may make appropriate designations of the Cooperation Materials under the Protective Order, and Plaintiffs may object to Settling Defendants’ confidentiality designations.

Nothing in this Paragraph shall prevent End-Payor Plaintiffs from using and/or introducing into evidence Cooperation Materials produced pursuant to Paragraphs 32-40, against any other defendants in the Automotive Parts Antitrust Litigation, 12-md-02311, to establish any of the above, subject to the terms and conditions set forth in the Protective Order in the Action, except as stated in Paragraph 36(a) and (f).
