Contracts Schedule has the meaning set forth in Section 4(m)(i).

Contracts Schedule means the schedule of rejected Executory Contracts that will initially be filed with the Plan Supplement and may be amended, modified, or supplemented (including by adding or removing Executory Contracts) at any time thereafter through and including the Confirmation Date.

Contracts Schedule means the schedule of Executory Contracts: (a) to be rejected pursuant to the Plan; and (b) to be assigned pursuant to the Plan to any Entity other than a Reorganized Debtor. Contracts Schedule. (i) no Contract set forth on the attached “Contracts Schedule,” has been breached in any material respect by the Company or canceled by the other party thereto, which breach or cancellation has not been duly cured or reinstated; (ii) no member of the Company Group is in receipt of any written claim of default under any such Contract dated less than ten days prior to the date of this Agreement; and (iii) each Contract listed on the attached “Contracts Schedule” is valid, binding and enforceable against the Company or one or more members of the Company Group, as applicable, except as such enforceability may be limited by (A) applicable insolvency, bankruptcy, reorganization, moratorium or other similar Laws affecting creditors’ rights generally, and (B) applicable equitable principles (whether considered in a proceeding at law or in equity).

Contracts Schedule shall have the meaning specified in Section 5H hereof.

Contracts Schedule. (i) no Material Contract has been breached in any respect or canceled by the other party that has not been duly cured or reinstated, (ii) the Company has performed all of its obligations required to be performed by it under such Material Contracts and the Company is not in receipt of any written claim of default under any such Material Contract, (iii) no event has occurred which with the passage of time or the giving of notice or both would result in a breach or default under any such Material Contract and (iv) the Company is not a party to any contract(s), agreement(s) or arrangement(s) which, individually or in the aggregate, could have a Material Adverse Effect. Each Material Contract is in full force and effect and is valid, binding and enforceable in accordance with its terms. Buyer has been supplied with a true and correct copy of all written Material Contracts requested by Buyer, together with all amendments, waivers or other changes thereto.
